In ancient times, if someone took it upon themselves to build a sanctuary or temple to a Deity, were they considered to be the priest or priestess of that sanctuary or temple by the state law?

Generally no. A temple or sanctuary would rarely have ever been built by a single private individual for personal use. A group of individuals with suitable qualifications would usually be hired for the purpose of maintenance of the site.
